Terms and Conditions – BandManager App

1. Purpose of the Terms

These Terms govern the access and use of the BandManager App (hereinafter referred to as "the App"). They set out the rights and obligations of the users and the publisher of the App.

2. Acceptance of the Terms

Using the App constitutes full acceptance of these Terms. If you do not agree with these conditions, please do not use the App.

3. Access to the App

• Access to the App requires registration and the creation of an account.
• Users are responsible for ensuring the information they provide during registration is accurate and up-to-date.
• Some features may require a paid subscription.

4. Services Provided

The App is designed to provide:

• Tools for managing a music band (members, rehearsals, events, etc.).

Features may change or evolve without prior notice.

5. User Responsibilities

• Use the App in compliance with applicable laws and regulations.
• Provide accurate and up-to-date information.
• Keep their login credentials secure and not share them with third parties.
• Avoid using the App to distribute illegal, harmful, or infringing content.

6. Liability

• User Liability: Users are solely responsible for the content they share or post through the App.
• Publisher Liability: The publisher will make reasonable efforts to ensure the App functions properly but disclaims liability for:
  • Temporary outages or technical malfunctions;
  • Data loss;
  • Indirect damages resulting from the use of the App.

7. Subscriptions and Payments

• Some features of the App may require a paid subscription.
• Pricing and payment terms are detailed in the App's "Subscriptions" section.
• Subscriptions are subject to additional conditions provided at the time of purchase, including cancellation and refund policies.

8. Personal Data

In compliance with applicable data protection regulations, including the General Data Protection Regulation (GDPR), your personal data is collected and used strictly within the scope of the App.

9. Modification of Terms

The publisher reserves the right to modify these Terms at any time. Changes will be notified to users through appropriate means before they come into effect.

10. Intellectual Property

All elements of the App, including content, design, logos, and trademarks, are protected by intellectual property laws. Unauthorized reproduction or exploitation is strictly prohibited.

11. Account Management, Sign Out, and Deletion

• Users can sign out from their account at any time via the "Sign Out" option in the App.
• Users are free to permanently delete their account. This can be done via the account settings in the app. After deletion, personal data will be anonymized or completely removed, unless legal retention obligations or legitimate interests require continued storage. Data contained in security-related backups will also be deleted retrospectively in the event of a system restore.

12. Duration and Termination

These Terms are valid for an indefinite period. Users may delete their account at any time through the App’s settings. The publisher reserves the right to suspend or delete an account if these Terms are not respected.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of Switzerland. Any disputes will be subject to the jurisdiction of the courts where the publisher’s headquarters is located, unless otherwise required by law.
